DO YOU NEED A WILL AND POWERS OF ATTORNEY?

Gilmore and Gilmore offers straightforward, and cost effective packages for Simple Wills and Powers of Attorney.

A few short definitions to help you understand what is meant by the terms ‘Simple Will / Power of Attorney’ and ‘Mirror Will / Power of Attorney’:

A Simple Will outlines clearly and succinctly what assets and property you have. The Will then indicates who you wish to gift those assets and property to. Your wishes may also include who will be guardians to your children, and your pets. An important part of the Will is choosing who you will entrust to carry out your wishes, this person is known as the Estate Trustee or Executor.

A Mirror Will is ideal for those individuals who are married or in a partnership and who have the same estate planning wishes. The Wills are almost entirely identical in that you and your partner will name each other as your primary beneficiaries, you then name your secondary beneficiaries. The second beneficiaries are the people or organizations who will ultimately receive your property after both of you pass away. This means that when the first partner passes away, they inherit all or most of the first partner’s estate and they are now responsible for ensuring the fulfillment of all other wishes that you have both decided are important.

Simple and Mirror Powers of Attorney for Property and Personal Care are very similar to Simple and Mirror Wills in that you will outline clearly who will act on your behalf when you are not capable of acting for yourself. You will outline clearly how you wish that person(s) to act; in short what you want them to do / not do in managing your property / financial interests, and what your wishes are for personal / medical care. It is very important to choose individuals to act as your Power of Attorney and Estate Trustee who are completely trustworthy, have a strong commitment to personal morality, and will honour your wishes even if your wishes do not fully align with their wishes / values.
